Understanding Minnesota DWI Laws

This is because it is illegal to operate a motor vehicle while “under the influence” of alcohol and/or drugs. Under Minnesota law, you can be charged with DWI if you are impaired by:

  • Illegal drugs
  • Prescription medications
  • Over-the-counter medications
  • And other substances

In other words, if a police officer believes that you are impaired by any substance and that your ability to drive safely has been negatively affected, you can be arrested for DWI. You can be arrested for DWI even if you are not taking any medication or other substance. If you are fatigued or drowsy and an officer believes this has impaired your ability to drive, you can still be charged with DWI.
